My husband and I had created a website a few years ago for our moms. They love to cook and the website included pictures and a menu of what family and friends can ask them to cook. It was Just for personal use, not for business... thus, we did not file the domain name under a fictitous name.

When we did our research for the perfect domain name to represent our moms natural talent and love for cooking, there was no other ownership.

Now, when referring to Our family to the website,  they&#039;ve mentioned the &quot;business.&quot; It turns out that there&#039;s now a company with our domain name with the same idea and profitting. 

Although, our domain was For personal use and not for business, can I use this letter to advise them to stop or change their business name due to &quot;trademark?&quot;</description>

While you can send a C&amp;D -- this, like most other smaller legal issues, usually winds up becoming a &quot;pissing contest&quot; where the offender (the company who ripped off your name) is simply going to call your bluff unless you get a lawyer to send the C&amp;D. If you have plenty of proof that you have created and chronicled the web design - such as PDFs, work orders, etc - that would definitely hold up to prove you&#039;re the rightful company here...but for now, you could send off a C&amp;D and see if they&#039;ll shake. Otherwise, it becomes kind of a dead end :( Good luck!</description>

Thanks for the very helpful info. I&#039;m trying to decide if a C&amp;D letter is necessary. Maybe you can help!

My company created a website for another company. We&#039;ve since stopped working with that company, however the company they are now using for web work has put at the bottom of the website we designed that the website was created by them.

This is obviously deceptive, as people will think they create work of our caliber - when they certainly do not. 

Now, they did move a few things around on the website - however the entire site includes our custom-made graphics &amp; writing.

Any advice would be great :-)
